This End User License Agreement (“EULA”) is a legal agreement between POSEBEN TECHNOLOGIES LLP (“Gamalogic”, “we”, “our”, or “us”) and the end user (“you” or “user”) governing your access to and use of the Gamalogic Email Validation and Email Finder software, website, APIs, or related services (collectively, the “Software” or “Services”).

By installing, accessing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install, access, or use the Software.

1. License Grant

Subject to your compliance with this Agreement and payment of all applicable fees, POSEBEN TECHNOLOGIES LLP grants you a limited, non exclusive, non transferable, revocable license to:

• Access and use the Software for your internal business purposes
• Integrate the Gamalogic API with your own systems or platforms and
• Use the documentation accompanying the Software to support your usage.

You may not sublicense, lease, sell, resell, or otherwise distribute the Software to any third party without written consent from POSEBEN TECHNOLOGIES LLP.

2. Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or modify the Software
• Circumvent or attempt to bypass usage limits or API restrictions
• Use the Software to build or support a competing product or service
• Use the Software in violation of any applicable law or regulation
• Access or use the Software to process or validate email data obtained unlawfully or without user consent

Violation of these terms may result in immediate termination of your license.

3. Ownership and Intellectual Property

The Software is licensed, not sold. All intellectual property rights, including trademarks, copyrights, source code, databases, and algorithms, are and shall remain the exclusive property of POSEBEN TECHNOLOGIES LLP.

• No ownership rights are transferred to you under this Agreement
• The “Gamalogic” name and logo are registered trademarks of POSEBEN TECHNOLOGIES LLP and
• Any unauthorised use of these trademarks is strictly prohibited.

4. Data Protection and Privacy

Your use of the Software is also governed by our Privacy Policy, Data Processing Agreement (DPA).

You are responsible for ensuring that your use of the Software complies with these laws and that any data you submit has been collected with proper consent.

5. User Obligations

• Provide accurate information during account registration
• Maintain confidentiality of your account credentials
• Use the Software in compliance with all applicable laws and regulations and
• Notify us immediately of any unauthorised access or breach.

You are solely responsible for all activity occurring under your account.

6. Subscription and Payments

• Fees are billed according to the pricing plan selected at www.gamalogic.com/pricing.
• Payments are non refundable except as required by law.
• We may suspend or terminate access if payment is not received on time.
• We reserve the right to modify pricing with reasonable notice.

7. Term and Termination

This Agreement remains in effect until terminated by either party.

You may terminate your license at any time by deleting your account and ceasing all use of the Software.

• Breach any provision of this Agreement
• Use the Software unlawfully or unethically or
• Fail to pay applicable fees.

Upon termination, you must discontinue all use of the Software, delete any downloaded materials, and destroy all copies of related documentation.

8. Service Availability

We strive to maintain 99.9% uptime for our API and related services. However, POSEBEN TECHNOLOGIES LLP does not guarantee uninterrupted or error free operation.

• Modify or discontinue features temporarily or permanently
• Suspend access for scheduled maintenance or emergency fixes.

We will make reasonable efforts to notify users of planned outages.

9. Warranties and Disclaimers

The Software is provided “as is” and “as available” without warranties of any kind.

• Merchantability, fitness for a particular purpose, and non infringement
• Accuracy, reliability, or completeness of validation results and
• That the Software will meet your expectations or operate without interruption.

10. Limitation of Liability

• Any indirect, incidental, special, or consequential damages
• Data loss, business interruption, or loss of profits
• Any damages exceeding the total amount paid by you in the preceding 12 months.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless POSEBEN TECHNOLOGIES LLP, its affiliates, and employees from any claims, damages, liabilities, or expenses arising from:

• Your use or misuse of the Software
• Your violation of this Agreement or
• Your infringement of any third party rights.

12. Updates and Modifications

We may modify this Agreement at any time by posting an updated version on our website. Your continued use of the Software after such changes constitutes your acceptance of the revised terms.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed under the laws of India, without regard to its conflict of law principles.
